Cowtown Classic Liability Waiver, Release, and Assumption of Risk
1. Assumption of Risk
I understand that participation in the Event involves inherent risks. Those risks include, but are not limited to: strains, sprains, broken bones, cuts, bruises, concussions, cardiac events, heat- and cold-related illness, permanent disability, and in rare cases, death. I understand that court surfaces can be slippery, that pickleballs and paddles can cause injury, that collisions with other players or fixed objects are possible, and that unrelated participants, spectators, and third parties may act carelessly. I accept and assume all such risks, known and unknown, foreseen and unforeseen.
2. Physical Condition and Medical Consent
I confirm that I am physically fit to participate and that I have no medical condition that would make my participation dangerous to myself or others. I authorize the Event organizers and their volunteers to provide or summon first aid, emergency medical treatment, or transport to a medical facility as they deem appropriate, at my expense.
3. Release and Waiver of Liability
To the fullest extent permitted by Texas law, I release, waive, discharge, and covenant not to sue the Cowtown Classic, Camp Summit, The Picklr Fort Worth, Blue Mesa Southwest Grill, their respective officers, directors, employees, volunteers, agents, sponsors, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising from or related to my participation in the Event, whether caused in whole or in part by the negligence of the Released Parties or otherwise, except for injury caused by the gross negligence or willful misconduct of a Released Party.
4. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including attorneys' fees, they may incur due to my participation in the Event or arising from my acts or omissions.
5. Photo and Video Release
I understand that photos and videos will be taken at the Event. I grant the Event organizers and Camp Summit permission to use my image and likeness in photos, videos, and recordings for promotional, fundraising, and educational purposes without compensation.
6. Governing Law
This waiver is governed by the laws of the State of Texas. Any dispute arising under it will be brought only in the state or federal courts located in Tarrant County, Texas. If any provision is found unenforceable, the rest of the waiver remains in full force.
7. Age of Majority
I am at least 18 years of age. If the participant is under 18, a parent or legal guardian must sign this waiver on the minor's behalf and the parent or guardian agrees to be bound by all of its terms.
8. Electronic Signature
I acknowledge that I have read this document, that I understand it, and that I am signing it voluntarily. By typing my name and drawing my signature below, I intend this to be my legal signature and I agree to be bound by the terms of this waiver. I consent to receive and sign this waiver electronically under the federal ESIGN Act and Texas Uniform Electronic Transactions Act.
